What Constitutes Domestic Or Family Violence?

Domestic and Family Violence is when someone has experienced, or been exposed to, any of the following behaviours from either someone they live with or have a domestic relationship with:

  • Physical assault
  • Sexual assault
  • Stalking
  • Intimidation
  • Harassment
  • Financial abuse
  • Emotional or psychological abuse
  • Coercive Control (denied independence or autonomy)

Applying For An AVO

We can assist with your application for an Apprehended Violence Order (AVO). If the Police do not take out an AVO on your behalf, we can help you make a private application for your future protection. When an AVO is issued, there is usually a time frame provided for which the AVO is to be in place. 

The conditions of an AVO are decided by a Judge and can be varied. The first condition is that the offender must not conduct themselves in any of the behaviours listed above that constitute family violence. 

If we seek additional Orders, a Judge may grant restrictions such as:

  • The offender is no longer able to reside in the same home as you/your children
  • Not allowed within a certain distance from where you/your children live, work or go to school
  • Not able to contact you/your children unless through a lawyer
  • Not allowed to be in the presence of you/your children for at least 12 hours after drinking alcohol or taking drugs

In the event the offender does not follow the Orders, that is considered a breach of the AVO. If the AVO is breached in any way, you need to notify Police immediately. If the conditions of an AVO are breached, then the offender has committed a criminal offence.

What If I Cannot Afford To Leave?

For anyone who has concerns about leaving a marriage or relationship for fear of not being able to afford to, it is important to know that there are avenues available to support you.

We listen to your needs and put you into contact with the right support services so that you and your children can have access to safe accommodation, food, clothing and necessities. Interim spousal or de facto maintenance may be another of those avenues. That is, where we can ask for agreement on your behalf, for funds to be provided, payable by your former spouse or partner, until a financial settlement can be finalised.

Also, we seek to reach an agreement on your behalf (or Court Orders if necessary) for the sole occupancy of your home with your children, with the exclusion to the offender. If required, we can apply for urgent Orders to help with this process.
