There are five key phases in the selling (and buying) process, whether it be residential or commercial:

  1. Pre-contract – This is when a contract for the sale of a property is prepared and a title search is undertaken to verify the owner of the property.

  2. Pre-Exchange – This is where the buyer may be required to pay a holding deposit to the real estate agent which is non-refundable if they do not proceed. There is a cooling off period during this time which is when the buyer is likely to arrange for inspections to be undertaken on your property (pest, building, strata are the most common).

  3. Exchange – This is the legal process where the contract for sale becomes binding between the buyer and the seller. The buyer has a cooling off period unless they waive this. When the cooling off period ends, the remainder of the 10% balance is due to you unless it is agreed for a lower amount to be paid.

  4. Settlement – This is when the purchaser takes possession of the property and all remaining finances are settled and the transaction concluded.

  5. After Settlement – This is when buyers secure their rights on a new mortgage and all transfer and title documents are signed and the transfer is registered.

Selling Your Property

If you are selling and you want to get your property on the market ASAP, we have a quick turnaround time for preparation of the contract. We can advise you of any special conditions we believe may benefit you and reduce any risks.

Thinking Of Buying Around The Same Time As Selling?

When you are buying and selling a property at the same time, there’s a lot that needs to be considered to make it a smooth process.

To do that you need a committed team who understand your needs, your time pressures and look out for any of the pitfalls that can so often arise.

If you are selling a property but waiting for your sale to be secure before putting an offer in on another property, there is often an inconvenience that is created when the settlement dates do not match up.

This means you will need to pay for a removalist to move your belongings out, find short-term accommodation and pay for storage of your belongings, while you wait for the settlement date on your new property. Sometimes that might be a week or two before, which means having to pay to move everything a second time. It is highly disruptive, inconvenient and costly.

Most people are focused on selling their property and searching for their new property and do not realise the implications until they have to manage them. However, when you have our team draft and review any contracts, we can negotiate with the buyers of your current property and the sellers of your new property.

That might mean we negotiate a variation to the settlement date or an agreement with your buyers to allow you to rent your property for a period of time until the settlement date for your new property.

We often negotiate special conditions in contracts that the other side is happy to accommodate, even in this competitive market. We can move fast so let us know if you’re considering placing an offer on a property in advance and we’ll accommodate you.
